It was alleged that the repair contractor failed to take steps to make the patch level with the surrounding surface. The fall fractured our client’s arm and she needed surgery to put in plates and screws.
Faraci Lange successfully resolved a case on behalf of a Canandaigua man and his wife against a podiatrist who treated him for two years for what he believed was a plantar wart. The lesion never responded to treatment and the podiatrist failed to take a biopsy until over 25 visits and then failed to take a sufficient sample. The lesion turned out to be verrucous carcinoma which had spread so deeply by the time it was diagnosed that amputation of the lower leg was required to save the man’s life.
Faraci Lange successfully settled a birth brain damage case on behalf of the child of a Canandaigua family after a one month long trial against the hospital and attending physician. Plaintiffs’ claimed that the hospital and attending physician failed to properly monitor the mother’s condition and progress resulting in the baby undergoing asphyxia at birth.
Faraci Lange successfully resolved a claim on behalf of a Canandaigua woman and her husband after she fell on ice on the driveway of her apartment complex. The driveway was defectively designed to allow water to pool and not drain off, such that when the temperature dropped below freezing ice would form in the depression. On the day of the incident there was a light dusting of snow that obscured the ice and the woman fell and suffered a severe patellar fraction. The case was resolved with the help of an expert architect who was able to show the defect in the construction of the driveway which caused the ice to form.
