We successfully resolved a case for a Fairport man who was hit by a truck while crossing the street. Our client was in the crosswalk, crossing with the light on Broad Street in Rochester when the driver of the pick-up truck failed to yield to a pedestrian, made an unsafe turn and struck our client. The plaintiff’s main injuries were to his left knee and included a displaced, depressed and severely comminuted tibial plateau fracture and a lateral meniscus tear. (In other words, his shin bone was broken into a number of pieces and he tore the outside cartilage of his knee.) The fractured area was crushed so extensively that no articular cartilage was left. The accident also injured his right elbow and caused numerous abrasions and contusions and he will eventually need a total knee replacement.


Faraci Lange successfully resolved a medical malpractice case for a Fairport woman who suffered radial nerve palsy after a surgery to treat an upper arm fracture. Following her surgery, our client began to notice loss of wrist and finger extension and slight numbness throughout her arm. During our investigation, we found that the doctor who performed her surgery used a poor surgical technique that did not permit proper visualization of the radial nerve which runs directly along the humerus (upper arm bone) and is not the best procedure to achieve bone union. The doctor then increased the risk of injuring the radial nerve by using cerclage wires around the humerus in a way that likely transected the nerve. The doctor should have used an open reduction procedure which allows visualization and isolation of the radial nerve and internal fixation with plates and screws. Our client’s prognosis for any improvement in fine motor function of her hand is poor and she will never be able to do such basic tasks as open a jar or make a bed.


Faraci Lange successfully resolved a medical malpractice case for a Fairport woman who underwent bariatric surgery. Shortly after her surgery, she manifested symptoms of internal leakage at the surgical site, but there was a delay in obtaining appropriate imaging studies to rule out a pulmonary embolism because certain equipment at the hospital was not working properly. This delay led to the development of a septic condition and the client ultimately lost one half of her foot and has severe abdominal scarring caused by multiple surgeries and a long healing process.


Faraci Lange successfully resolved a case for a young Fairport man. He was a front seat passenger in a vehicle when the driver ran a stop sign in Penfield, went into the woods and hit a tree. He suffered a severely fractured left radius that required open surgical reduction and internal fixation with a metal plate and screws. He also sustained bruised knees, stitches on his chin, a wound on his forehead and had three laparoscopic incisions in his abdomen because they questioned whether his bowel burst.


Faraci Lange successfully resolved a case on behalf of a Fairport woman who lost sight in one eye due to a corneal infection. The patient was admitted to the hospital for severe depression and was unable to care for herself. At the time of admission she had contact lenses in which was not discovered by the staff. She then developed an infection which festered for over a week as the antibiotic eye drops given to the patient could not reach the site of the infection due to the contact lens. The result was severe corneal scarring, and a corneal transplant was unsuccessful in restoring eyesight.


Faraci Lange successfully prosecuted a claim for failure to timely diagnose colon cancer. The Fairport resident had a positive guaiac test. Despite the positive guaiac test the physician failed to order a colonoscopy. Sometime later the patient developed symptoms. A colonoscopy revealed the patient had colon cancer. The patient required multiple surgeries and treatments.


Faraci Lange successfully resolved a claim on behalf of a Fairport resident who suffered a traumatic brain injury as a result of a motor vehicle accident. It was claimed that the motor vehicle accident arose due to driver road rage. As a result of the injury, the patient lapsed into a coma.


Faraci Lange successfully resolved a claim on behalf of a Fairport woman and her husband who was given the wrong medication by a pharmacy. Instead of receiving a blood pressure medication she received an anti-seizure medication that caused a permanent loss of memory.
