Faraci Lange effectively resolved a medical malpractice claim for a Hornell man whose injuries were improperly diagnosed when he sought treatment after injuring himself at work. The defendants failed to properly diagnosis a heel fracture in our client’s right foot. As a result, the client was encouraged to put weight on the fracture, which caused it to heal in poor position. Once the fracture was properly diagnosed, it was too late to perform surgery. The plaintiff developed a malunion as a result of the delayed diagnosis and later developed arthritis in the associated joint. If the surgery had been carried out in the immediate post-injury period, he likely would not have developed arthritis as quickly as he did, and he likely would have been able to stay on the job longer.
