Faraci Lange successfully resolved a claim on behalf of a Rochester couple who were severely injured when another driver ran a stop sign, colliding into their family vehicle. As a result, one of the plaintiffs sustained a C2 fracture, a tibial plateau fracture, and a rib fracture, requiring a halo device, an extensive hospitalization and physical therapy. (Comminuted lateral tibial chondo/plateau fracture and comminuted non-displaced patellar fracture) The other spouse sustained multiple rib fractures and a lacerated spleen.


Faraci Lange successfully resolved a claim on behalf of a Rochester woman who tripped over a re-stocking clothing rack that was protruding from the bottom of a circular display while shopping at a popular discount retailer. The fall left the plaintiff with a right knee injury that required arthroscopic knee surgery and a left hip injury that required a total hip arthroplasty and two subsequent hip procedures. Our client now suffers from daily pain and will require the use of a cane for the rest of her life. 


Faraci Lange successfully resolved a fall case on behalf of a Rochester man who was injured when he tripped on a long table cloth while at an event. It was claimed that greater care should have been exercised to keep the table cloth from posing a trip hazard. The fall caused the client to fracture his femur, necessitating surgery to install a rod and screws.


Faraci Lange successfully resolved a defective product claim for a Rochester man who lost the tip of his left small finger while using a tire changing machine. The design of the machine was new and it created an unguarded opening between the bead of the tire and the rim, allowing a dangerous pinch point. The plaintiff was changing a customer’s tire using the machine when his left small finger became trapped and the tip was severed.


We successfully resolved a case for a young Rochester girl who was hit by a car while crossing the street with her grandmother. The young girl sustained a right ankle fracture with right foot growth plate injury and a right shin bone injury. Doctors also found bone and cartilage fragments in the ankle and a torn anterior tibiofibular (ankle) ligament. Long term effects of the incident include subsequent arthroscopic surgery for removal of the bad tissue and to remove the loose bodies. She will also likely suffer from early onset post traumatic arthritis in her ankle.


Faraci Lange successfully resolved a medical malpractice claim for a Rochester man who was injured during surgery to remove a Schwannoma (or benign nerve sheath tumor) from his pelvis. During surgery, nerve tissue connected to the Schwannoma was transected resulting in significant motor deficits and neuropathic pain. Unfortunately, subsequent nerve graft surgery was unsuccessful leaving our client with constant nerve pain that ranges from a dull, aching pain to a stabbing pain that shoots up his left leg. Our client can no longer ride a bike or go jogging for exercise and only narcotic medications make the pain bearable. This case was successfully settled before having to go to trial.


We successfully resolved a case for a Rochester woman who developed spinal accessory neuropathy after a procedure to remove plaque from her left carotid artery. It was determined during the course of a subsequent surgery to treat the injury that the nerve had been cut or severely damaged during the initial surgery. The expert retained on behalf of the client reported that under the circumstances, this was an injury that could only have happened due to inattention during the original surgery. Because the spinal accessory nerve controls the shoulder muscles, our client was left with a significant permanency that affects her ability to lift her arm above shoulder level.


Faraci Lange successfully resolved a case for a Rochester man who was in a motorcycle accident on St. Paul Blvd when another driver suddenly pulled out in front of him from a side road. Our client sustained serious fractures on his left wrist and left ankle, both of which required surgery. Because of a long rehabilitation period, the client (who was self-employed in a personal service business) was unable to work and had income loss as well as substantial pain and disability. The case investigation produced a witness who supported our client’s position and thus, the case settled for the driver’s policy limits.


Faraci Lange successfully resolved a premises liability claim on behalf of a Rochester man who was injured at a friend’s apartment when he stepped onto the front porch and his left foot went through the decking up to his groin. His knee was wrenched when his foot hit debris situated underneath the porch resulting in a significant left knee meniscal tear and eventually leading to a total knee replacement. The porch was in poor repair and the tenants had complained to the landlord about its condition, although the landlord denied ever receiving complaints from the tenants.


Faraci Lange successfully resolved a claim for a Rochester woman against her obstetrician/gynecologist. During a laparoscopic hysterectomy, the obstetrician/gynecologist transected the client’s ureter, and then failed to diagnose this injury for several weeks while the client was in extreme pain. The client has been left with serious permanent urological complications including, among others, incontinence.


Faraci Lange successfully resolved a case on behalf of a Rochester bicyclist who was hit by a car that made a left-hand turn in front of him. His injuries included a severe acetabular (hip) fracture and related nerve injury. He has been undergoing long term physical and medical therapy for severe disability and persistent neuropathic (nerve) pain.


Faraci Lange successfully resolved a case on behalf of a Rochester resident who was rushed to the hospital in the early stages of an embolic stroke. In the emergency department he was evaluated to be an excellent candidate for the drug tPA which is a (thrombolytic) clot-busting medication when given in the early stages of an embolic stroke can have a significant beneficial effect. Unfortunately, the patient was mistakenly given another drug, TNK, which is also a thrombolytic but used as a cardiac medication, and this drug was given at an improper dose because the dosing information for the tPA was used, causing further complications.


Faraci Lange successfully tried to jury verdict a case involving a Rochester man who had surgery on his parotid gland and after the completion of the surgery it was discovered that his leg had come off of the operating table and he suffered a nerve injury to his leg. The defense had contended that his injury was not the fault of the hospital staff and that his injury was not serious or permanent.


Faraci Lange successfully resolved a claim on behalf of a severely brain damaged infant and her family from Rochester when the doctors caring for her failed to recognize the signs and symptoms of fetal hypoxia and failed to deliver her promptly. She now requires 24 hour care for the rest of her life.


Faraci Lange successfully resolved a case on behalf of a Rochester woman who presented to her primary care physician complaining of a lesion on her back that had changed color and grown larger in recent months. The doctor told her it was nothing to worry about, but it was later diagnosed as melanoma and had invaded deep into the dermis by that time significantly increasing her risk of recurrence and death from the condition.


Substantial verdict to injured Rochester homeowner against an outdoor grill manufacturer who made a grill not reasonably safe for foreseeable use which caused it to explode and cause significant burn injuries.


Faraci Lange successfully resolved a case during jury selection brought on behalf of the Estate and surviving wife and children of a Rochester man who slipped and fell on existing black ice in the parking lot of the defendant hotel where he had been staying. He struck the ground with his head and died as a consequence of a brain injury. The claim was based on the fact that the hotel had notice of the dangerous condition and did nothing to remedy it.


Faraci Lange successfully resolved a case brought on behalf of a man who had slipped and fallen on some loose floor tiles in a gas station where he had just made a purchase. He sustained soft-tissue injuries, which were superimposed on preexisting degenerative arthritis and spinal stenosis, which had not been causing any symptoms or disabilities. The combination of injury superimposed on the preexisting condition caused a chronic permanent pain syndrome to develop, which significantly disabled the plaintiff. The claim was based on the fact that the condition of loose tiles had existed for a long period of time and had not been corrected.


Faraci Lange successfully resolved a case on behalf of a Rochester woman who during a contrast CT scan had the contrast material injected outside of the vein and into the soft tissue of the back of her hand resulting in compartment syndrome and a permanent nerve injury.


Faraci Lange successfully resolved a birth brain damaged baby case on behalf of a Rochester couple on the third day of jury deliberations after a one month long trial. The claim was that the hospital and acting physician had not taken the baby by C-Section though there was clear evidence that the baby was in distress and was lacking oxygen.


Faraci Lange successfully resolved a claim on behalf of a Rochester iron worker who during the construction of a mall fell from a steel I beam and suffered a severe head injury. The worker was not provided with a safety line on which to tie off which resulted in his hitting the floor and not being saved by his safety belt. The case was resolved against the owner and general contractor of the construction site who were found liable by the court under the New York Labor Law.


Faraci Lange successfully resolved a claim on behalf of a Rochester electrician who fell from a step ladder that he was forced to use because the owner and general contractor did not provide appropriate scaffolding. The man suffered a severe and permanent leg injury that prevented him from returning to his former work. The court found the owner and general contractor of the construction site liable under the New York Labor Law.


Faraci Lange successfully resolved a case on behalf of the Estate, wife and son of a town Judge who was admitted to the hospital with severe pancreatitis, and who died three days later as a result of the hospital’s mismanagement of the patient’s fluid therapy.


Faraci Lange successfully resolved a birth brain damaged baby case on behalf of a Rochester couple on the third day of jury deliberations after a one month long trial. Faraci Lange successfully resolved a case, just prior to jury selection, for a woman who had undergone an unnecessary surgical removal of her right breast followed by reconstruction. The surgery resulted from an error in the diagnosis of the biopsy specimen made by the pathologist who reported the cells as cancerous when in fact they were not.


Faraci Lange successfully settled a case just prior to jury selection on behalf of a woman who had undergone a rupture of her uterus and bladder during labor and as a result lost her uterus and suffers from a permanent pain syndrome. She was undergoing a trial of labor though she had previously had a C-Section. The claim was that VBAC patients are subject to higher risks of rupture of the uterus during labor. Plaintiff claimed that the patient should not have been in defendant hospital and attended by a family practice physician because neither could meet the standard of care for VBAC patients, which required the ability to do an immediate C-Section if signs of rupture were observed.


Faraci Lange successfully resolved a case in favor of a man, against a hospital, and his primary care physician for not properly working up his cardiac history after the onset of severe chest pain. The patient went on to sustain a severe heart attack which permanently damaged over 50% of his heart leading to a substantial decrease of cardiac function.


Faraci Lange successfully resolved a case in favor of a thirty-eight year old mother brought against her oncologist for failure to properly treat a thyroid cancer, which allowed it to progress and metastasize and go from stage one cancer with a favorable prognosis to a stage four cancer with a dismal prognosis.


Faraci Lange successfully tried to verdict a case on behalf of a Rochester man who suffered multiple fractures to his facial bones and required plastic surgery after he was hit by a car as he was crossing W. Henrietta Road in the City of Rochester.


Faraci Lange successfully prosecuted a claim on behalf of a Rochester woman who developed Reflex Sympathetic Dystrophy, Complex Regional Pain Syndrome, as a result of a motorcycle accident. As a result of the injuries the patient will require lifelong medications to address the severe pain.


Faraci Lange successfully tried to verdict a case on behalf of a child from Rochester and his family. The child suffered severe lead poisoning due to chipping, peeling lead paint in his apartment that was reported but never remedied. The child suffered a permanent brain injury as a result of the lead poisoning which resulting in severe learning disabilities and personality disorder.


Faraci Lange successfully represented a young woman in a product liability action against a large national retailer. While she was making tea, her nightgown, which was supposed to be fire resistant, ignited and despite her best efforts, she was unable to extinguish the flames because of the well known propensity of certain types of cotton garments to re-ignite after the flames appeared to be extinguished. She sustained 2nd and 3rd degree burns to her torso and arms.


Faraci Lange made a successful recovery by jury verdict following a two week trial on behalf of a construction worker who was severely injured when he fell from an elevated work station while working on construction. The claim was based on the failure of the general contractor and owner to provide adequate safety railings as required by the Labor Law. The construction worker suffered permanent neck and back injuries, which rendered him totally disabled.

The action was brought against the owner of the property where the construction was occurring for failing to meet their Labor Law duty regarding workers working at an elevated work station.

The claim was based on the failure of the general contractor to adequately protect its workman with the proper safety devices.

He was totally and completely disabled and confined to an institution for the rest of his life. The claim was brought against the manufacturer of a portable electric powered whirlpool unit, which was represented as safe for home use but in fact, was not. Underwrites laboratory had not accepted the unit for listing for home use because the standard of wiring necessary for safe use could not be guaranteed in homes throughout the country.


Faraci Lange made a successful recovery on a jury verdict against a Swedish manufacturing company of dialyzers on behalf of a twenty-eight year old man who sustained a permanent total bilateral hearing loss as a result of the manufactures negligence in recommending a method of use of its dialyzers which proved to be ototoxic to patients. The manufacturer recommended the doubling of dialyzers in each treatment, which caused a heavier concentration of chemicals to enter the patient’s blood stream then was safe.


Faraci Lange successfully resolved a case against a manufacturer of a heart valve, which was implanted in the plaintiff and which proved to be defective. The plaintiff suffered consequent heart dysfunction and required the removal of and implantation of another heart valve.
