Faraci Lange Professionals to Host Medical Malpractice Webinar

The law firm of Faraci Lange LLP is co-hosting a webinar about potential medical malpractice claims, Monday, Sept. 20, 2010 from 12 to 1 p.m.

The webinar, “Screening and Investigation Potential Medical Malpractice Claims,” is co-hosted by  Brian Zorn, Faraci Lange partner, and Elizabeth Zorn, legal nurse consultant, as part of the American Association of Legal Nurse Consultants’ (AALNC) monthly educational webinar series.

Brian Zorn is one of Faraci Lange’s senior trial attorneys focusing his practice on medical malpractice.  Elizabeth Zorn, BSN, RN, LNCC, has been an AALNC member for more than 15 years and recently began a three-year term on its board of directors.

The AALNC is a not-for-profit membership organization dedicated to the professional enhancement and growth of registered nurses practicing in the specialty of legal nurse consulting and to advancing this nursing specialty. AALNC is the preeminent resource for professionals with an interest in the legal nurse consulting arena including novice and veteran legal nurse consultants.

Julie Jordan Wins Up and Coming Attorney Award

Jordan focuses her practice on medical malpractice, complex tort and toxic tort, premises liability, products liability and automotive negligence cases. She previously practiced as an associate in the litigation department at Woods Oviatt Gilman LLP.

Jordan is a member of the American Association for Justice, the New York State Academy of Trial Lawyers, the Monroe County and New York State Bar Associations, and the Greater Rochester Association for Women Attorneys.

A cum laude graduate of Syracuse University College of Law, Jordan earned her bachelor’s degree from the University of Rochester. She is a resident of Farmington, N.Y.

Faraci Lange Attorneys Recognized In 2009 Superlawyers Listings

The 2009 SuperLawyers Listings have been released and once again Faraci Lange attorneys are right at the top. Five Faraci Lange attorneys (Angelo G. Faraci, Paul K. Lange, Joseph A. Regan, Stephen G. Schwarz and Brian M. Zorn) were selected in the category of Plaintiff Medical Malpractice, representing all but one of the six lawyers from Rochester selected in this category. The same five attorneys from Faraci Lange were the only attorneys from Rochester selected in the Plaintiff Product Liability category. Four Faraci Lange attorneys (Faraci, Lange, Regan and Zorn) were selected in the Personal Injury – General category and Schwarz was also listed in the Environmental Litigation category.

The Unfairness of New York’s Medical Malpractice Statute of Limitations

Statutes of Limitations are legally binding rules that establish time periods within which a lawsuit or claim must be filed. They are generally bright lines that once passed will forever bar even a clearly meritorious lawsuit. That said, there are certainly valid policy reasons for the imposition of time periods for the initiation of legal proceedings. The statute of limitations embodies the principles that the value of evidence diminishes over time and that parties to a dispute need closure, so fairness dictates that the person bringing the lawsuit act with speed and efficiency to preserve these principles.

Of course, fairness is a two way street: the time periods are generally crafted to give the party bringing the lawsuit sufficient time to learn they have been harmed. Indeed, in many States, the time periods do not begin to run until a person knows or reasonably should know that they have been injured. It is in this regard that the New York statute of limitations in medical malpractice cases is so unfair. More…

Upcoming Appeal in Rochester Should Settle Whether New York Public Health Law §2801-d Claims can Coexist with Common Law Negligence Claims Brought By Injured Nursing Home Patients

New York Public Health Law §2801-d provides a statutory remedy to nursing home patients for injuries suffered as a result of the deprivation of certain rights or benefits granted by contract, or by applicable federal and state law. The statute mandates an award of compensatory damages of no less than twenty-five percent of the nursing facility’s daily rate for each day the patient’s injury exists. In addition, it provides for punitive damages and attorneys’ fees in appropriate circumstances.

Faraci Lange lands five lawyers on list of Super Lawyers for Upstate New York

The Rochester, New York law firm of Faraci Lange, LLP was recognized in the 2008 Upstate New York addition of Super Lawyers with five of its attorneys listed in this prestigious publication. Founders Angelo G. Faraci and Paul K. Lange were both listed in the personal injury section, while Joseph A. Regan, Brian M. Zorn and Stephen G. Schwarz were listed in the medical malpractice section.
