After more than 20 years (14 years as an equity partner) with one of the largest law firms in the country, Nixon Peabody LLP, Mr. Cook joined the trial firm of Faraci Lange in 2010 in order to offer clients a new approach to traditional law firm billing arrangements. Combining Mr. Cook's wide ranging commercial litigation experience with the unmatched trial experience of Faraci Lange provides Faraci Lange the ability to offer commercial clients litigation representation under a risk sharing billing model. Faraci has the flexibility and structure to develop billing models unique to a client’s specific needs that focus on favorable outcomes; not billable hours.

Commercial and Real Estate Litigation – Mr. Cook has extensive experience in commercial, environmental and real estate litigation including insurance coverage, zoning and land use, eminent domain, landlord/tenant disputes, real estate contract disputes, toxic torts, and construction. Mr. Cook has handled cases in jurisdictions throughout New York as well as in Pennsylvania, Ohio, Michigan, Kentucky, Idaho, Utah, Iowa and Connecticut.

Discrimination, Labor and Employment - He has advised both employers and employees on severance and termination issues, including non-compete agreements, and wage and hour claims under the Fair Labor Standards Act. Mr. Cook has litigated several Civil Rights § 1983 claims including police abuse and excessive force. He has handled discrimination cases dealing with age, sexual harassment, religion, disability, and race.

Agribusiness - Mr. Cook is one of the leading agribusiness lawyers in New York. He has been involved with nearly every major enforcement action brought by Federal and State regulators against agricultural operations in New York. He represents major dairy and other agricultural operations throughout the Northeast. 

Environmental - Mr. Cook has represented a wide range of corporate clients in proceedings before the Environmental Protection Agency (“EPA”) and state equivalents throughout the country. This representation has involved both individual and joint representation of Potentially Responsible Party (“PRP”) groups as “common counsel.” He has been lead counsel in providing comments to major regulatory proposals by both EPA and New York State under the Clean Water Act and Clean Air Act.

Personal Injury – Mr. Cook has tried serious injury cases, to verdict, both on behalf of plaintiffs and defendants.

In addition to the Monroe County Bar Association, the New York State Bar Association, and the American Bar Association, Dave is also a member of the American Agricultural Lawyers Association and the American Trial Lawyers Association.

He has volunteered his time and served on the board of directors for Habitat for Humanity, Farmworker Legal Services of New York, Interfaith Forum of Rochester, and the Boy Scouts of America. He has received numerous awards recognizing his pro bono work including the 2010 Pro Bono Award from the U.S. District Court, Western District of New York, the Presidents Pro Bono Service Award from the New York State Bar Association, and the William McNight Pro Bono Award from the Volunteer Legal Service Project.

Other awards Dave has received include the Empire State Counsel Recognition from the New York State Bar Association and the 40 under 40 Award from the Rochester Business Journal. He was a finalist for the Daily Record’s Nathaniel Award and was also a member of Leadership Rochester. He is also currently a member of the Rochester Rotary Club. In addition to being a memeber of the New York State Trial Lawyers Association, Dave has been awarded Martindale-Hubbell’s highest rating and has been a member of New York Super Lawyers from 2007 - 2009, and again in 2011.
