From 2013 – 2014, three laboratories tested formaldehyde emissions from laminate flooring sold at national retail stores. Lumber Liquidators laminate flooring emitted the highest levels of formaldehyde gas in violation of the California Air Resource Board (CARB) standards, as well as Toxic Substances and Control Act standards. In 2014 and 2015, 60 Minutes conducted its own investigation by testing 31 boxes of various Chinese-made flooring products from a number of Lumber Liquidators stores throughout the country. The results of the testing revealed that all but one box violated CARB standards.

Despite the excess formaldehyde emanating from the Chinese-made laminate flooring, Lumber Liquidators sold its flooring nationwide as compliant with CARB standards. It represented on its product labels and its website that its products comply with strict CARB formaldehyde standards. Consumers relied on this promise when they purchased Lumber Liquidators' laminate flooring and installed it in their homes.

The Dangers of Formaldehyde

Formaldehyde is classified as a known human carcinogen by the United States Environmental Protection Agency. Medical studies have revealed an association between nasopharyngeal cancer and myeloid leukemia and long-term formaldehyde exposure. According to the Center for Disease Controls' Agency for Toxic Substances and Disease Registry (ATSDR) Toxicological Profile on formaldehyde, the most common symptom experienced by individuals who are exposed to elevated levels of formaldehyde is irritation of the eyes, nose, and throat. One large study of individuals with asthma found that they may be more sensitive to inhalation of formaldehyde. A small number of studies have also looked at the health effects of formaldehyde in children. According to ATSDR, "It is very likely that breathing formaldehyde will result in nose and eye irritation (burning feeling, itchy, tearing, and sore throat)."
