How Do You Succeed in a Defective Drug or Medical Device Claim?

Like other product liability claims, succeeding in a defective drug or medical device claim requires proof of a design or manufacturing defect or proof that the instructions or warnings on the drug or medical device were insufficient. To prove these claims requires an extensive knowledge both of the medical and scientific issues but also of the complex regulatory structure surrounding the FDA's approval process for drugs and medical devices.

Why Choose Faraci Lange, LLP?

Our attorneys have a long history of representing individuals harmed by defective pharmaceutical drugs and medical devices. In the past, our Rochester defective drug and medical device attorneys have represented clients in the Vioxx litigation and silicone breast implant litigation. More recently, we have settled claims and continue to settle claims related to use of Yaz and Ocella, Avandia, Pradaxa, and several metal-on-metal hip implants, including DePuy ASR and Biomet M2a implants.

Faraci Lange, LLP had the lead trial case (McCracken v. DePuy Orthopaedics, Inc., et al.) among more than 8,000 cases filed in the DePuy ASR MDL. This case was adjourned on the eve of trial so that the parties could finalize a global settlement that encompassed all the cases in the MDL where the plaintiff was revised prior to August 31, 2013. Faraci Lange, LLP has also been appointed by the court to leadership roles in national hip implant litigation. Attorney Hadley E. Lundback was appointed by the MDL court in the Biomet metal-on-metal hip implant MDL to the Plaintiffs' Steering Committee, and she was appointed by the MCL court in the Stryker Rejuvenate/ABGII hip implant litigation to the Science Committee.

In addition to experienced drug and medical device attorneys, we have nurses on staff who assist in researching the medical issues involved in each case, reviewing clients’ medical records and preparing discovery materials for each plaintiff to help ensure the best possible result.
