Faraci Lange has successfully resolved thousands of cases for clients since 1968. Here are some summaries of just a small percentage of the death claim cases that we have handled successfully.
Faraci Lange successfully resolved a claim on behalf of the family of a Holley man who died of pneumonia. He developed respiratory symptoms and went to his doctor who prescribed one course of antibiotics. The infection did not respond to the antibiotic prescribed by the doctor and although his symptoms worsened, he was never sent for another chest x-ray or hospitalized. As a result, the infection worsened and he passed away.
Faraci Lange successfully resolved a claim on behalf of the family of a Horseheads woman who died in child birth due to complications from pre-eclampsia. The woman displayed all of the signs and symptoms of this relatively common but potentially fatal condition but was not hospitalized for immediate delivery of the baby, which is the only effective treatment. Instead, her blood pressure became severely elevated and she suffered a vascular injury to her brain and died.
Faraci Lange successfully resolved the claim during trial of a Greece woman whose husband died of malignant mesothelioma after working for 35 years at Eastman Kodak Company as a sheet metal worker and being exposed to asbestos used in insulation and other products at work. The claim was settled with numerous manufacturers of products containing asbestos that were used at Kodak by workers such as the decedent.
Faraci Lange successfully tried to verdict a claim on behalf of a Spencerport man and his family who died of malignant mesothelioma. The man worked for 30 years at Rochester Gas & Electric as a pipe coverer, working daily with asbestos containing pipe covering, block and cement. Punitive damages were also awarded due to the failure to warn of hazards of asbestos that were well known to the manufacturer at the time. This was proven through records showing that a large number of employees of the manufacturer had contracted the same disease over many years prior to the exposure by the decedent.
Faraci Lange successfully settled a case during jury selection on behalf of the Estate and the son and daughter of an eighty-two year old widower who was seriously injured in a motor vehicle accident, which caused him to suffer a massive stroke, which left him paralyzed and bedridden. He died two months later after considerable pain and suffering. The defendant driver had failed to yield the right of way at a stop sign and entered the intersection and broadsided plaintiff’s car.
Faraci Lange successfully resolved a case during jury selection brought on behalf of the Estate and surviving wife and children of a Rochester man who slipped and fell on existing black ice in the parking lot of the defendant hotel where he had been staying. He struck the ground with his head and died as a consequence of a brain injury. The claim was based on the fact that the hotel had notice of the dangerous condition and did nothing to remedy it.
Faraci Lange successfully resolved a case on behalf of the Estate and surviving mother of a construction worker who fell from the Driving Park Bridge into the Genesee River Gorge and was killed. The claim was based on the failure of the general contractor to adequately protect its workman with the proper safety devices.
Faraci Lange successfully represented the Estate and surviving husband and children of a thirty-six year old woman who died as a result of contracting guillian barre syndrome from the injection of a swine flu vaccine. The claim was made against the medical facility that injected the vaccine and the United States.
Faraci Lange successfully resolved product liability actions for six Western New York residents who died from malignant mesothelioma after working for many years in the plastic molding industry. Malignant mesothelioma is a rare cancer of the lining of the lung and peritoneum caused by exposure to asbestos. Prior to 1980, some plastic molding compounds contained asbestos as a component. These workers were exposed to the fiber at work and later developed and died from malignant mesothelioma.
Faraci Lange successfully resolved a medical malpractice action for the family of a Geneva man who died from peritonitis. The man, who had recently undergone a knee replacement, went to the emergency room of a local hospital with symptoms of an infection. A blood test was taken, the results of which had not been reported before the man had been released. The blood test showed that the man had an infection and the results were reported to the emergency room, but nobody contacted the man or his doctor to inform them that he had an infection and was in need of immediate treatment. Three days later he returned to the hospital with a serious septic infection. Despite aggressive treatment he died two days later. Had the blood test result been properly communicated and treatment initiated, the man’s infection was curable. The three day delay caused his death.
Faraci Lange successfully resolved a case on behalf of the Estate, wife and son of a town Judge who was admitted to the hospital with severe pancreatitis, and who died three days later as a result of the hospital’s mismanagement of the patient’s fluid therapy.
