Faraci Lange has successfully resolved thousands of cases for clients since 1968. Here are some summaries of just a small percentage of the product liability cases that we have handled successfully.


Faraci Lange successfully represented a young woman in a product liability action against a large national retailer. While she was making tea, her nightgown, which was supposed to be fire resistant, ignited and despite her best efforts, she was unable to extinguish the flames because of the well known propensity of certain types of cotton garments to re-ignite after the flames appeared to be extinguished. She sustained 2nd and 3rd degree burns to her torso and arms.


Faraci Lange successfully tried to verdict a case on behalf of a Spencerport man who lost control of a three-wheel ATV and crashed into a tree suffering a cervical fracture resulting in quadriplegia. The ATV was defectively designed with a high center of gravity and enormous power such that when the front wheel came off of the ground it caused the rider to twist on the throttle and caused him to lose control and hit a tree.


Faraci Lange successfully resolved a claim on behalf of a mechanic Dansville man whose hand was severely injured by a defective McPherson Strut Spring Compressor Machine. The defective machine allowed the powerful strut spring to prematurely release catching the man’s hand. He eventually developed reflex sympathetic dystrophy to the hand and it had to be amputated. Even after the amputation, he suffered from constant severe phantom pain to that limb.


Faraci Lange successfully resolved a claim on behalf of Macedon man who was injured while operating a forklift truck at work which was not equipped with a protective cage. The man suffered a fractured spine when pipes he was carrying came loose and fell on him and was rendered paraplegic. Had the forklift been designed and equipped with a safety cage the injury would not have occurred.


Faraci Lange successfully resolved a product liability action for a Dansville man who sustained a herniated lumbar disc and hernia when the seat of his new lawn tractor failed, causing him to fall off of the back of the tractor. Our expert was able to demonstrate that the cause of accident was a fatigue failure that resulted when the manufacturer drilled a hole in the steel mount that was too close to the edge of the mount. A crack formed that failed suddenly while the tractor was in use. The manufacturer agreed with our expert’s analysis and settled the case before suit.


Faraci Lange successfully resolved case in favor of forty-nine year old husband and father who suffered severe brain damage as a result of an electrical accident. He was totally and completely disabled and confined to an institution for the rest of his life. The claim was brought against the manufacturer of a portable electric powered whirlpool unit, which was represented as safe for home use but in fact, was not. Underwrites laboratory had not accepted the unit for listing for home use because the standard of wiring necessary for safe use could not be guaranteed in homes throughout the country.


Successful recovery on a jury verdict against a Swedish manufacturing company of dialyzers on behalf of a twenty-eight year old man who sustained a permanent total bilateral hearing loss as a result of the manufactures negligence in recommending a method of use of its dialyzers which proved to be ototoxic to patients. The manufacturer recommended the doubling of dialyzers in each treatment, which caused a heavier concentration of chemicals to enter the patient’s blood stream then was safe.


Faraci Lange successfully resolved a case against a manufacturer of a heart valve, which was implanted in the plaintiff and which proved to be defective. The plaintiff suffered consequent heart dysfunction and required the removal of and implantation of another heart valve. 


Faraci Lange successfully represented the Estate and surviving husband and children of a thirty-six year old woman who died as a result of contracting guillian barre syndrome from the injection of a swine flu vaccine. The claim was made against the medical facility that injected the vaccine and the United States.


Faraci Lange successfully resolved a case on behalf of a Deputy Sherriff who was seriously injured when the left front control arm of his new vehicle became disengaged from the frame and resulted in his losing immediate control of the vehicle, and to strike a tree. The disengagement from the frame occurred as a result of a defect. The Deputy Sherriff was rendered partially paralyzed in his lower trunk and lower extremities. He was permanently and totally disabled.


Substantial verdict including punitive damages in product liability case where manufacturer made defective product which injured working electrical lineman from the Town of Greece.


Substantial verdict to injured Rochester homeowner against an outdoor grill manufacturer who made a grill not reasonably safe for foreseeable use which caused it to explode and cause significant burn injuries.


Faraci Lange successfully resolved a case against designer and manufacturer for injured Victor hunter who fell while putting up a deer stand with inadequate design, inadequate safety warning and inadequate user instructions. The 15 foot ladder stand had a three section ladder the sections of which were held together by a male/female joint with no device to prevent the ladder sections for separating. The man sustained a serious spinal injury when the top section separated from the platform while he was ascending the ladder. 


Faraci Lange Faraci Lange successfully prosecuted a claim on behalf of a Webster resident who suffered severe eye injuries as a result of a defective spring mechanism. The spring mechanism caused severe trauma to the eye, requiring multiple surgical procedures, including a corneal transplant. Client now has a deformity to the eye, as well as diminished vision and photosensitivity. 


Faraci Lange successfully resolved a claim against Cub Cadet for a defective mechanism in a lawn tractor that allowed power take-off to operate without the knowledge of the operator causing severe hand injury.
