Examples of successful no fault insurance claims resolved by Faraci Lange

Faraci Lange has successfully resolved thousands of cases for clients since 1968. Here are some summaries of just a small percentage of the no fault insurance cases that we have handled successfully.

Matthew Belanger, a Partner in the firm, successfully challenged a no-fault denial of claim for a shoulder surgery performed on a client who sustained multiple injuries in a head-on collision that killed the at-fault driver. Our client sustained multiple serious injuries in the accident, including significant mechanical injuries to both shoulders. The most serious injury was to the right shoulder and initially, that shoulder was the focus of the medical team treating our client. As that shoulder improved, our client complained increasingly about the left shoulder, on which he had an arthroscopic procedure about 18 months after the motor vehicle accident. The No-Fault carrier disclaimed based on a “peer review” of our client’s records by another orthopedic surgeon. It was clear that the “peer review” did not consider many relevant records that showed that our client had never complained of any left shoulder injuries prior to this accident and that he had regular and unabated complaints after it. After pointing out the obvious flaws in the analysis of the peer review, we convinced the No-Fault carrier to get another, more comprehensive, review after which the carrier paid for our client’s left shoulder surgery.
